1. Introduction

Welcome to Wikora. These Terms and Conditions ("Terms") govern your access to and use of the Wikora platform, including all content, features, and services provided by Wikora (collectively, the "Service"). By accessing or using Wikora, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Wikora is a private knowledge platform that enables users to create, edit, and manage their own encrypted content. Your wiki page content is encrypted and private, and Wikora does not access, view, use, license, or copy your content. These Terms establish the rules and guidelines for using our Service and outline the rights and responsibilities of both users and Wikora.

2. Acceptance of Terms

By creating an account, accessing, or using Wikora, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Wikora.

If you are using Wikora on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and the terms "you" and "your" will refer to that organisation.

Important: If you do not agree to these Terms, you must immediately stop using Wikora and may not access or use any part of the Service.

3. User Accounts

3.1 Account Registration

To access certain features of Wikora, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use of your account

3.2 Account Eligibility

You must be at least 13 years of age to create an account on Wikora. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to share your account credentials with any third party. Wikora is not liable for any loss or damage arising from your failure to maintain the security of your account.

4. User Content

Content Privacy and Encryption: Your wiki page content is encrypted and stored privately. Wikora does not access, view, read, copy, use, or license your encrypted content. You retain complete ownership and control over your content.

4.1 Content Ownership

You own all content you create, upload, or store on Wikora ("User Content"). Wikora does not claim any ownership rights in your User Content. You retain all intellectual property rights in your content.

4.2 Content Responsibility

You are solely responsible for all User Content you create or store on Wikora. You represent and warrant that:

  • You own or have the necessary rights to use your User Content
  • Your User Content does not infringe any third-party rights
  • Your User Content complies with all applicable laws and regulations
  • Your User Content does not contain malicious code, viruses, or harmful components

4.3 Wikora's Limited Access

Wikora provides the technical infrastructure to store your encrypted content but does not have access to, view, read, copy, use, or license your encrypted wiki page content. Your content remains private and encrypted. Wikora cannot and will not review, edit, or moderate your encrypted content as we do not have access to it.

4.4 Content Deletion

You may delete your User Content at any time through your account. Upon deletion, your encrypted content will be permanently removed from our systems. Wikora may suspend or terminate accounts that violate these Terms, but we cannot access or review your encrypted content as part of this process.

5. Intellectual Property Rights

5.1 Wikora's Intellectual Property

The Service, including its original content, features, functionality, design, and software, is owned by Wikora and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms do not grant you any right, title, or interest in or to the Service or any Wikora trademarks, logos, or other brand features.

5.2 Your Intellectual Property

You retain complete ownership of all intellectual property rights in your User Content. Wikora does not claim any ownership rights in your content. You do not grant Wikora any license to use, copy, reproduce, or distribute your encrypted content, as we do not have access to it.

6. Content Licensing

No Licensing to Wikora: You do not grant Wikora any license to use, copy, reproduce, modify, distribute, or display your encrypted wiki page content. Wikora does not access, view, or use your content, and therefore requires no license from you.

Your content remains your exclusive property. Wikora provides only the technical infrastructure to store your encrypted content securely. We cannot and do not license, use, or access your private, encrypted content.

You retain all rights to license your content to third parties as you see fit. Any licensing decisions regarding your content are entirely yours to make, and Wikora has no involvement in such decisions.

7. Prohibited Uses

You agree not to use Wikora in any way that:

Violates any applicable laws or regulations
Infringes upon the rights of others
Contains defamatory, libellous, or false information
Includes hate speech, harassment, or discriminatory content
Contains sexually explicit or pornographic material
Promotes violence or illegal activities
Contains spam, phishing, or malicious content
Attempts to gain unauthorised access to systems
Interferes with or disrupts the Service
Impersonates any person or entity
Collects user data without consent
Uses automated systems to access the Service

8. User Conduct

When using Wikora, you agree to:

  • Respect other users and their privacy
  • Use the Service in accordance with these Terms
  • Maintain the security of your account and content
  • Comply with all applicable laws and regulations
  • Not use the Service for illegal or harmful purposes
  • Report security issues or violations when encountered

Wikora is built on principles of privacy and user control. We expect all users to use the Service responsibly and in accordance with these Terms.

9. Content Moderation

Important: Wikora cannot review, edit, or moderate your encrypted wiki page content as we do not have access to it. Content moderation is limited to account-level actions and publicly visible account information only.

Wikora reserves the right to:

  • Suspend or terminate accounts that engage in prohibited activities
  • Take legal action against users who violate applicable laws
  • Cooperate with law enforcement authorities when required
  • Implement security measures to protect the Service
  • Remove publicly visible account information that violates these Terms

Due to the encrypted nature of your content, Wikora cannot access or review your wiki pages. You are solely responsible for ensuring your content complies with these Terms and applicable laws. Users are encouraged to report account-level violations through our reporting mechanisms.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in your account settings. Upon termination, your right to access and use Wikora will immediately cease.

10.2 Termination by Wikora

Wikora may suspend or terminate your account and access to the Service immediately, without prior notice, if you violate these Terms or engage in any conduct that we determine, in our sole discretion, is harmful to the Service or other users.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Your encrypted content will be permanently deleted from our systems in accordance with our data retention policies. You are responsible for backing up your content before termination. Provisions of these Terms that by their nature should survive termination will survive, including Sections 5, 11, 12, and 13.

11. Disclaimers

Content Accuracy: Wikora is a collaborative platform, and content is created and edited by users. We do not guarantee the accuracy, completeness, or reliability of any content on Wikora. Content is provided "as is" without warranty of any kind.

Service Availability: Wikora provides the Service on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

You acknowledge that you use Wikora and rely on content at your own risk. You should independently verify any information before relying on it, especially for important decisions.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wikora and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any content or conduct of third parties on the Service
  • Unauthorised access to or alteration of your content
  • Any errors or omissions in any content
  • Any interruption or cessation of the Service

In no event shall Wikora's total liability exceed the amount you paid to Wikora in the twelve months preceding the claim, or £100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wikora and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your violation of any applicable laws or regulations.

14. Changes to These Terms

Wikora reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of Wikora after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Governing Law

By using Wikora, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, you must not access or use Wikora.
